Employer are required, as part of the procedural duty to accommodate, to inquire into an employee’s possible misuse of addictive substances.  Indeed, an employer must remain open to the possibility of an addiction even after it receives an initial denial from the employee.  Arbitrators accept that addiction denial is integral to the disease of addiction, and employers must always be alert to its potential causal link to workplace misconduct and poor performance.
